Decree 143/2018/ND-CP takes effect: Removing obstacles to compulsory social insurance for foreign employees working in Vietnam
The Government has recently issued Decree 143/2018/ND-CP on October 15th 2018 elaborating on Law on Social insurance 2014 and Law on Occupational safety and hygiene 2015 regarding compulsory Social insurance for employees who are foreign nationals working in Vietnam (“Decree 143”). As from 1st January 2018, the Law on Social insurance 2014 and Law on Occupational safety and hygiene 2015 has expanded the scope of application of compulsory Social insurance for foreign employees working in Vietnam ("Foreign employees"). However, in reality, lack of guiding documents has caused some confusion not only enterprises and foreign employees but also competent state agencies during the process of implementation. The promulgation of Decree 143 plays a vital role in removing problems of social insurance contribution as the foregoing mentioned, thereby ensuring the legitimate rights for foreign employees and being the basis for implementation of Bilateral and Multilateral Convention on social insurance that Vietnam has participated in.
