Transfer of the entire outward investment capital to foreign investors

AUTHORITY		Ministry of Planning and Investment (Foreign Investment Department) - MPI.
PROCEDURE
	Step 1:	Before transferring the entire outward investment capital to the foreign investor, the investor must notify the State Bank of Vietnam;
	Step 2:	The investor submits the application for termination of validity of the outward investment registration certificate at MPI;
	Step 3:	MPI checks the validity of records; In case the dossier is not sufficient and needs clarification, MPI shall send a written request to the investor to request the completion of the dossier;
	Step 4:	MPI consults with the State Bank of Vietnam on foreign exchange transactions of the project and other related issues, if any;
	Step 5:	MPI issues a written notice of invalidation and revocation of the IRC to foreign investors, and at the same time sends a copy to relevant Ministries.
SUBMISSION OF DOSSIER		Investors submit documents directly or by post to the Ministry of Planning and Investment.
DOSSIER
	Number:	The investor submits 02 sets of documents (including 01 set of original documents).
	Elements:	1. A written request for termination of validity of an outward investment registration certificate;
		2. The original of the outward IRC;
		3. Decision to terminate investment projects in foreign countries according to the competence specified in Article 59 of the Law on Investment;
		4. Documents proving that the investor has completed the termination and liquidation of the project and transferred all money, assets, and revenues from the project's termination or liquidation back home;
		5. Documentation of investor's legal status.
ADMINISTRATIVE FEES		None.
DURATION		15 days from the date of submission of valid dossier.
SUBJECT		Investors (individuals; organizations) or individuals and organizations authorized by investors.
RESULT		Valid dossier: Written notice of invalidation and revocation of an outward investment registration certificate;
		Invalid dossier: Notify in writing investor to complete the dossier.
