Re-issuing the work permit

AUTHORITY		Ministry of Labour – Invalids and Social Affairs or Provincial/City Department of Labour – Invalids and Social Affairs (depends on the location where the foreign worker expects to work).
PROCEDURE
	Step 1:	File a dossier for issuing Work permit at Ministry/Department of Labour – Invalids and Social Affairs where the foreigner expected to work before at least 15 days from the expected working date;
	Step 2:	Ministry/Department of Labour – Invalids and Social Affairs appraisal the dossier for re-issuing Work permit;
	Step 3:	Ministry/Department of Labour – Invalids and Social Affairs issue the permit if the dossier meets the requirement of the law.
SUBMISSION OF DOSSIER		Submit the dossier directly.
REQUEST FOR IMPLEMENTATION		The valid work permits is lost;
		The valid work permits is damaged;
		Change in name, nationality, passport number, working address written in the current work permit.
DOSSIER
	Number:	01 dossier.
	Elements:	A proposal form for re-issuing work permit of the employer;
		02 color photos (4cm x 6cm size, white background, front view, bare head, no color glasses), taken within 6 months before the submission the dossier;
		The granted valid work permit: In case the work permit is lost, a confirmation of the commune police office where the foreign worker resides or a competent authority is needed; In case the contents in work permit need to change, there must be proof document attached to this dossier.
		An acceptance of demand for foreign workers.
DURATION		03 working days.
SUBJECT		Enterprise which uses the foreign worker; foreign worker expected to work in Vietnam.
RESULT		Valid dossier: Work permit;
		Invalid dossier: Dispatch of refusal to issue a work permit clearly stating the reason.
LEGAL BASIS		Labour Code 2019;
		Decree no. 152/2020/ND-CP on foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign employers in Vietnam.
